Representation in Immigration Court

An attorney must be eligible to practice law in and be a member in good standing of the bar of, the highest court of any U.S. state, possession, territory, or Commonwealth, or of the District of Columbia.

In addition, an attorney cannot be under any order from the Board suspending, enjoining, restraining, disbarring, or otherwise restricting him or her in the practice of law. An attorney under any order of discipline (including orders of other federal bodies or state licensing authorities) may be subject to discipline by the Board, including the immediate suspension of a practitioner who has been disbarred or suspended by a federal or state court.
